Under Thai law, a prenuptial agreement is authorized and recognized. This is a legal agreement which is enforceable in Thailand, and also may take effect outside Thailand. At some point, there are rules among other countries wherein agreement such as this be evaluated for it to be accepted as well in their countries.

Thailand prenuptial agreement is not only common among second or third marriages, but also has been considered even for first-time marriages. This has become a practical way, a realistic approach on seeing things in the event of divorce. Ownership of properties in Thailand has been classified into two:

  1. Sole properties
  2. Communal properties

Sole properties are separate properties owned by the husband and the wife. These are properties which are personally owned by either party before the marriage. It includes inheritance, gifts or personal items.

Communal properties, on the other hand, are conjugal assets, jointly owned properties of both husband and wife. Mostly, these properties are referred to as what has been bought, purchased and acquired during the time of marriage. From these categories, a prenuptial agreement is necessary to be able to divide and come up to which properties it falls under.

A divorce maybe a straightforward process when both mutually agrees to end the marriage. But, most instances, it has been a tug-of-war. Most divorcing couples does not have a good relationship when it comes to negotiations, giving so much pressure on who’s at fault.
